2. General Terms and Conditions (AGB)

2.1 Scope

These general terms and conditions apply to all sales contracts concluded between you (the customer) and AthletiKuss via the online shop www.athletikuss.com . By placing an order, the customer accepts these terms.

2.2 Contract Formation

The presentation of goods on the online shop does not constitute a binding offer. By clicking “Order” and completing payment, the customer makes a binding offer to purchase. The contract is concluded when the order confirmation is sent by email.

2.3 Prices and Payment

All prices are in Swiss Francs (CHF) and include statutory VAT where applicable.
Payment is due upon order.
Payments are processed via Shopify Payments and selected third-party providers
Delivery costs will be shown separately before checkout.

2.4 Delivery

Delivery within Switzerland to the delivery address provided.
Estimated delivery time: 3–7 business days
The risk of loss or damage passes to the customer upon delivery to the shipping provider.

2.5 Retention of Title

The goods remain the property of AthletiKuss until full payment has been received.

2.6 Warranty & Defects

All products are covered by the statutory 2-year warranty in accordance with Swiss law (Art. 197 ff. OR).
This warranty covers manufacturing defects present at the time of delivery.
It does not cover normal wear and tear, improper use, or damage caused by incorrect care.
If a defect is confirmed, we will provide a replacement or refund at no cost

2.7 Returns / Cancellation

Swiss law does not grant a statutory right of withdrawal for online purchases., however:

- Returns accepted within 5 days of receipt if items are unworn and in original condition.
- Return shipping costs are borne by the customer.
- Refunds processed within 10 days of receiving the return.

2.8 Liability

Liability is limited to intentional and grossly negligent behaviour.

2.9 Governing Law and Jurisdiction

Swiss substantive law applies exclusively (excl. CISG). In disputes with consumers, they may choose legal action either at their Swiss residence or at the seller’s registered office.

7. Warranty & Defects

7.1 Statutory Warranty

In accordance with Swiss law, a statutory warranty period of two (2) years applies to all clothing products purchased from AthletiKuss. The warranty covers defects that already existed at the time of delivery.

Normal wear and tear, improper use, incorrect care (e.g. washing contrary to care instructions), alterations made by the customer, or damage caused after delivery are excluded from the warranty.

7.2 Reporting Defects

Customers are required to inspect the goods immediately upon receipt and to report any defects without undue delay after discovery.

7.3 Warranty Remedies
